Uma abordagem axiológia e jurídica frente a prática da prostituição

Abstract

In Brazil, the legislation that deals with prostitution is still focused on combating voluntary sex work, through ambiguous normative content and few definitions. Prostitution, in turn, deals with exchanging sexual favors for money. Although it is considered by many to be the oldest profession in the world, (including being recognized in Brazil as a profession since 2002 by the Ministry of Labor and Employment), the labor regulation for this profession seems to be far from happening. Public opinion is divided between those who defend and those who condemn those who exercise it. The latter use arguments that match the moral sphere and subjective criteria such as aversion and/or prejudice. The movement itself is divided between a person's right over his or her body and the need to protect sex workers from sexual exploitation. However, this profession can be defended considering the constitutional principles of human dignity, the social values of the office and free enterprise. This work was carried out through the deductive method, using the methodology of scientific literature review based on data analysis; The general objective was to elucidate the volatilization of rights when the subject falls on certain social groups, in this case, prostitution; As well as exposing the search for units, entities and political fronts in the reinterpretation of certain legal provisions and also exposes how much moral and patriarchal values distort reality, affecting the rights of those who adhere to the practice of prostitution.
