Abstract

The present study aims to uncover certain aspects prompted in the civil and notarial areas by the use of georeferencing of rural buildings. The research has shown that there have been reflections generated by georeferencing on the civil and notarial spheres, which have influenced the registration rectifications carried out both in the extrajudicial sphere and in the processes of voluntary jurisdiction. It was also noted that georeferencing becomes necessary in the cases of judicial and extrajudicial usucaption, which may generate an increase in cases involving the possession and ownership of properties due to the detection of registration inconsistencies. The application of georeferencing might result in the dismissal of the production of expert evidence in the cases of demarcation and partitioning, prompting processual promptness and saving. Finally, it was noted that rural mapping might result in legal uncertainty in ad mensuram contracts, due to the imposition by the judges of discrepant measurements to the jurisdictionals.
