Assédio moral e a sua criminalização: identificando as diferentes manifestações do abuso no ambiente de trabalho

Abstract

This scientific article aims to analyze moral harassment in the workplace and what has been done to criminalize and punish this type of abusive conduct in Brazil. In addition, the survey will comment on what can be expected for the future, in terms of putting an end to the perpetuation of impunity. The study intends to scrutinize the peculiarities of abuse, as well as dealing with the difficulty of punishment that still exists, while it becomes difficult to identify moral aggression, either because it often occurs silently away from eyewitnesses, or even by the unconscious acceptance of the victim and others who witness psychological violence. Therefore, throughout the work, the institutionalization and virtual “normalization” of bullying in the Brazilian labor environment will be discussed. Based on this understanding, the aim is to contribute to the awareness and indignation of society in the face of these abuses. From this perspective, the evolution and emergence of regulations that may bring hope and security to victims will be presented not to be silent in the face of these moral violations, which threaten the inherent dignity of every human being.
