A responsabilidade civil do juiz

Abstract

This article analyzes the civil liability of the judge and the State, due to the delay in resolving conflicts. It has a brief history regarding the principle of civil liability of the judge, where initially the figure of the judge was the personification of the State in the figure of the judge. Bringing questions about acts that could hold the State and even the judge responsible for errors made in their judgments. Also the responsibility of the State regarding the duty to repair the damage and the delay in the judicial provision, both of which can be classified in the same way, since these situations caused by the judicial provision of the State, may end up causing damage to the litigating parties. Also covered will be the personal responsibility of the judge, guilt and deceit, and the repair of damage.
