A PROTEÇÃO PREVIDENCIÁRIA AOS TRABALHADORES PRECARIZADOS NA ECONOMIA DIGITAL

Abstract

The present article aims to highlight the precarious social security conditions to which workers in the digital economy are exposed, providing a brief historical overview of the evolution of labor and social security over the years, as well as the mechanisms of social contributions, which fail to cover innovative forms of work that differ from traditional models. The objective is to understand the necessity of contributing to the social security system and the risks faced by these workers due to the absence of such contributions, leaving them vulnerable in case of workplace accidents and unable to continue their professional activities. Therefore, the article seeks to analyze, through the applied methodology, the precariousness experienced by these workers, aiming to understand the gap in the legal framework regarding this issue, which urgently requires updates to include and adapt to new work modalities. In this context, PLP 12/2024 is examined as a potential solution to this legislative gap, aiming to integrate these workers into the social security system, granting them the right to access its benefits. The conclusion is that this branch of law requires updates and adaptations, as legislation must evolve alongside society to ensure the rights of digital economy workers and reduce existing inequalities. In light of the above, and considering the provisions already established in Brazilian legislation to create a fair and equitable society, it is pertinent to question whether the lack of updates indicates regression, thereby jeopardizing the lives of thousands of unprotected workers.
