| Resumo: | Atualmente têm aumentado os números de crimes virtuais, onde os mesmos são derivados de um contexto tecnológico ao decorrer da evolução das últimas décadas, facilitando assim, qualquer tipo de atividade diária de uma pessoa. Seja no tocante a transferência bancária, pagamentos, compras, jogos, redes sociais, blogs, todos no âmbito virtual. Portanto, o crime de estelionato cibernético tem se destacado devido à vulnerabilidade das vítimas que usufruem da internet para otimizarem seus afazeres durante o dia. O presente artigo abordou todo contexto estruturado do crime de estelionato online, expondo as legislações vigentes, destrinchando as formas de prevenção dos golpes e eficácia da justiça punitiva em face do infrator, cumprindo a lei constitucional protetiva do estado inerente aos direitos fundamentais e garantias não apenas na esfera física, mas abrangendo todo corpo cibernético. |
| Abstract: | Nowadays, the number of cybercrimes has increased, as they are derived from a technological context during the evolution of the last decades, facilitating any type of daily activity of a person, be it regarding bank transfers, payments, purchases, games, social networks, blogs, all in the virtual environment. Therefore, the crime of cyber fraud has been highlighted due to the vulnerability of the victims who use the Internet to optimize their daily tasks. The present article addressed the whole structured context of the crime of online fraud, explaining the current laws, outlining the ways of preventing frauds and the efficacy of punitive justice against the offender, complying with the protective constitutional law of the state inherent to the fundamental rights and guarantees not only in the physical sphere, but covering the entire cybernetic body |
