Abstract

The social networking sites brought a new way of relating and meeting people, and despite all the positive side of the interaction, conflicts have become routine in the virtual world. Whenever a user offends the honor and image of another user virtually, he or she commits an illegal act and could be held responsible for it, whether in moral or material ways. The present work focuses on clarifying that, although there is so much freedom and lack of specific regulation, the Internet and social networking sites are not a “land without law”. The Marco Civil da Internet intervened to fill some gaps, and the jurisprudence, although not being unison, is responsible for making virtual offending agents responsible, be it this user or even the hosting provider of the social networking site. This topic, although much discussed, is constantly evolving, forcing the legal world to evolve at the same speed as social networking sites and the Internet, so as not to run the risk of remaining outdated.
