Da justiça gratuita no processo do trabalho e o pagamento de honorários sucumbenciais: um retrocesso ao acesso à justiça

Abstract

This work was developed from the perspective and basis of research and doctrinal studies, having as its source, mainly the electronic support of the vast content spread throughout the network, which can be found in this article briefly, explained and with solutions hitherto. little debated for the theme. The aim is to present the reasons that led to the payment of succumbential fees in the labor process (it is understood the obligation of the worker, if overdue, to bear such burden) even for the party benefiting from “FREE JUSTICE”, and the consequences of such a procedure in the course of labor justice, and in the obstruction created to the hyposufficient individual in the legal relationship, of access to justice. To achieve this goal, it will be treated in this work by the institute “FREE JUSTICE” since its beginnings in Brazilian law, through its function, concept, changes occurred throughout the legislative construction of the homeland, as well as its current status of application.
