Da aplicabilidade da justiça restaurativa nos conflitos e na violência escolar

Abstract

The present article will bring the problematic of Restorative Justice, questioned if it is an adequate system for the resolution of conflicts and school violence and, for such, will use the indirect, deductive empirical methods and the documentary and bibliographical analysis of books. It will also discuss the characteristics of violence itself and the concept of violence in schools; In addition, this article exemplifies and exposes the types of school violence, which are strongly associated with endogenous and exogenous violence, and will explain the Child and Adolescent Statute as a traditional mechanism for school violence. In the background, it will discuss the ineffectiveness of retributive justice, the current criminal-punitive system applied in Brazil. In addition, it will present the Restorative Justice regarding its application in the criminal sphere, its conceptualization and the way in which it develops in comparison with the system of retributive justice, applied in the national legal system. In addition, it will explain the way Restorative Justice presents itself in the legal context of the country today. And, finally, starting from a critical analysis on the subject, it will conclude the present work demonstrating that the Restorative Justice ends in a method that is properly adequate to be applied in the resolution of conflicts, especially in school violence.
