Título: | Inexigibilidade de tributação sobre os benefícios fiscais do reintegra e do crédito presumido de ICMS |

Resumo: | O presente artigo adentra na problemática da integração de valores de benefícios fiscais como se fizessem parte da receita empresarial, indo a fundo no conceito de receita e faturamento. Tais conceitos estão atrelados e são aplicados nas bases de cálculos dos Tributos que utilizam os mesmos como hipótese de incidência, sendo o Imposto sobre a Renda das Pessoas Jurídicas (IRPJ) e Contribuição Social sobre o Lucro Líquido (CSLL) incidente sobre o lucro, e a contribuição ao Programa de Integração Social (PIS) com a Contribuição para o Financiamento da Seguridade Social (COFINS) incidente sobre a receita. Apresenta-se análise da sistemática dos benefícios fiscais de Crédito Presumido do Imposto de Circulação de Mercadorias e Serviços (ICMS) e do Regime Especial de Reintegração de Valores Tributários para as Empresas Exportadoras – REINTEGRA, destacando a impossibilidade da inclusão dos valores recebidos a título dos benéficos fiscais no conceito de receita e faturamento. Nesse sentido, faz-se necessário o destaque do entendimento doutrinário e jurisprudencial sobre o conceito de receita e faturamento, conceitos-chave para aplicação correta da base de cálculo dos tributos que incidem os mesmos. Com a inclusão dos valores relativos a esses benefícios fiscais no conceito de receita e faturamento, a União, juntamente com o fisco, ofendem princípios aplicados ao direito tributário, sendo o princípio da capacidade contributiva, o princípio da estrita legalidade. Além disso, ocorrem o enriquecimento ilícito e a vantagem indevida da União em desfavor dos contribuintes, devendo ressarcir ou compensar o contribuinte ilicitamente onerado. |
Abstract: | The present article addresses the issue of the integration of tax benefits values as if they were of the business revenue deepening the concept of revenue and billing that is applied to tributes’ calculation basis that use it as incidence hypothesis, being the taxation on the Legal Enties’ Income (IRPJ), the Social Contribution on the Net Profit (CSLL), the Contribution to the Social Integration Program (PIS) and also the Contribution to Social Security Financing (COFINS). It presents the analysis of the tax benefits of the Circulation of Goods and Services PResumed Credits (ICMS) and Special Regime for Reintegration of Tax Values fox exporting companies – REINTEGRA systematic, highlighting the impossibility of including the values received under tax benefits in the concept of revenue and billing. Being necessary the feature of the doctrinal and jurisprudential understanding on the revenue and billing concepts, important concepts for the correct application of calculation basis on the taxes that affects them. With the inclusion of the values when it comes to these tax benefits on the revenue and billing concept, the Union, along with the tax authorities, offends applied principles on the tax law, being the principle of the contributory capacity and the principle of the strict legality. In addition to illicit enrichment and the Union advantege in detriment of taxpayers, having to reimburse or compensate the taxpayer unlaw fully charged. |
