| Resumo: | O presente trabalho tem por escopo conceituar a Reprodução Humana Assistida e as principais técnicas utilizadas, sendo elas: Inseminação Artificial, Fertilização in vitro com Transferência Embrionária e a Gestação de Substituição. No entanto, procura-se enfocar a técnica da gestação de substituição, considerada uma técnica de reprodução humana assistida muito discutida atualmente. Objetivou-se interpelar especialmente, quanto à eficácia do método, dando ênfase aos aspectos jurídicos relacionados ao assunto. Analisamos, no decorrer da pesquisa, a legislação em vigor e as considerações doutrinárias, bem como as orientações da Resolução nº 2.121/2015 do Conselho Federal de Medicina. Ao final, após a análise doutrinária e legislativa, pretendeu-se alavancar uma reflexão mais aprofundada quanto a disponibilidade presunção mater semp certa est, ressaltando a ligação genética e afetiva. |
| Abstract: | The present work aims to conceptualize Assisted Human Reproduction and the main techniques used, being: Artificial Insemination, In vitro Fertilization with Embryo Transfer and Substitutionary Gestation. However, we try to approach the technique of replacement gestation, considered an assisted human reproduction technique currently discussed. The objective was to address especially the effectiveness of the method, emphasizing the legal aspects related to the subject. During the course of the research, the legislation in force, the doctrinal considerations, as well as the guidelines of Resolution No. 2.121 / 2015 of the Federal Council of Medicine will be analyzed. In the end, after the doctrinal and legislative analysis, it is intended to leverage a more indepth reflection on the availability of presumption “Mater Semp Certa Est”, highlighting the genetic and affective connection. |
