Filiação socioafetiva e os aspectos legais da paternidade

Abstract

Nowadays socio-affective filiation has been acknowledged and reshaped by the evolution of society. The judiciary has been recognizing as fathers and mothers people who have only affectional bonds with their children, unlike the biological parents who are fully recognized by the law and society due to the genetical bonds between them and their children. Therefore, this paper aims to demonstrate the judicial aspects that led to the recognition of socio-affective filiation by the state, as well as to discuss the relevant social function of theme of parenthood and love, taking into consideration the protection of the child and the adolescent according to the judiciary, the current understanding that the judiciary has on the theme.
