Abstract:
Teleworking is a form of external work, without the employer's views.It is only
considered teleworking if the requirements of the employment relationship are
present, which are: personality, subordination, natural person, non-eventuality and onerousness. Telework distinguishes itself from distance work, since distance work covers not only telework, but also any type of external work, including selfemployment. In Brazil, there was no regulation in teleworking, only an equalization, bringing obscurity to the relations between employee and employer, especially in matters involving work, subordination, and occupational safety and health. With Law number 13,467/2017 teleworking has been regulated, bringing legal certainty to labor relationships.
