Da impossibilidade da desconstituição da paternidade socioafetiva a posteriori

Abstract

When observing the current social development, it’s possible to note in a clear way the change of the family definition, once that the family that are constituted by only the father, the mother and the children aren’t the pattern anymore. This development also brought innumerable innovations, even in the family formation. It is possible to use as examples families constituted by many different forms, from people with the same gender or an only person, not being necessary the father figure. The present work seeks to clarify the multiple types of family’s concepts over the time, as well as the possibility in the legal order of the affective and biologic parent’s recognition and the impossibility of this desconstitution. It is necessary to observe the human person dignity, once the impossibility of the paternity disregard avoid that the child suffer unnecessary situations, which interfere in their peaceful coexistence in society.
