O paralelo entre o acesso à justiça e a forma temerária de uso dos juizados especiais cíveis

Abstract

This paper analyzes the scope of the Special Civil Courts (know as “Juizados Especiais Cíveis”) and the high incidence of reckless litigation in their jurisdiction. In this sense, the composition of the Special Courts and their principles will be introduced. After, the relation between the culture of litigation and personal injury with the increasing incidence of undue demands and mass actions, pointing out the main reasons for the occurrence and the importance of the judges and lawyers to cease these actions. Finally, possible solutions will be presented to the demands discussed, such as the Multiple Port System, as well as possible sanctions to be applied by the judges to the lawyers who file the lawsuits seeking only personal injury damnation, leaving aside the real interest of their clients.
